Law Commission: Mental Capacity and Deprivation of Liberty Update

Below is an update from the Law Commission about the consultation that they ran in 2015. It was about making the law work better for people who sometimes cannot make decisions, this is called not having capacity. This can mean that sometimes people have to stay in a hospital or get treatment and care and they are not free to leave the place that is giving them treatment, this is called deprivation of liberty. The Law Commission looked at the law around this to try and make it better.

They did a consultation in 2015 and have written an update in the meantime so that people can get an idea about what people said in the consultation and an idea about what might happen moving forward:

The final report and the draft bill will be ready in December 2016.
